Judge throws out Fargo lawsuit
Jamestown North Dakota 121 3rd St NW 58401

FARGO, N.D. (AP) -- A judge has thrown out a lawsuit filed by a Fargo-based electronic transactions company against an Illinois company in the same business.

Intercept Corp. had filed a trademark infringement lawsuit against Accertify Inc. of Itasca, Ill., and its fraud-prevention service called Interceptas.

Officials with the Fargo company believe the Interceptas name could be confusing and deceptive.

U.S. District Judge Ralph Erickson said in his ruling that the case should not be heard in federal court because Accertify does not have enough contacts in North Dakota.
