Warrant issued for Jamestown man
A bench warrant was issued for a Jamestown man after he failed to attend a preliminary hearing Monday on a gross sexual imposition charge. The charge is a Class A felony punishable by 20 years in prison and a $20,000 fine.
Jordan Aaron Smith, who is either 18 or 19, was scheduled to appear in Southeast District Court Monday before Judge Thomas Merrick. Smith is accused of engaging in a sexual act with a minor under the age of 15 while he was older than 18 but younger than 22. The incidents are alleged to have occurred between Oct. 23, 2013, and Nov. 5, 2013.
William Mackenzie, his court-appointed counsel, listed numerous efforts to reach Smith by mail and by phone.
“It goes back to the beginning,” he said. “I’ve never seen the guy.”
Fritz Fremgen, Stutsman County state’s attorney, requested that Merrick issue a warrant for Smith’s arrest. Mackenzie said he had no comment in regard to the warrant.
Smith had appeared for a bond hearing on Jan. 8 before Judge John Greenwood and was released on a personal recognizance bond.
