Prison expert: Accused Smart kidnapper incompetent
A psychologist for the federal prison system says the man charged with the 2002 abduction of Elizabeth Smart understands the accusations against him but isn't competent for trial.
SALT LAKE CITY (AP) — A psychologist for the federal prison system says the man charged with the 2002 abduction of Elizabeth Smart understands the accusations against him but isn't competent for trial.
Dr. Richart DeMier evaluated Brian David Mitchell over 45 days in December 2008 and January 2009.
He testified Wednesday that Mitchell understands the charges against him along with the court process and roles of the judge, prosecutors and his own attorneys.
But DeMier says Mitchell can't make rational decisions about his defense and believes God will ultimately rescue him.
DeMier testified in U.S. District Court during a hearing to determine if Mitchell is competent to stand trial on charges of kidnapping and unlawful transportation of a minor across state lines.
Prosecutors contend Mitchell is competent.
