Settlement approved in N.D. Medicaid case
A judge has paved the way for a class action settlement with the North Dakota Department of Human Services for reimbursements from personal injury claims for Medicaid recipients.
FARGO, N.D. (AP) — A judge has paved the way for a class action settlement with the North Dakota Department of Human Services for reimbursements from personal injury claims for Medicaid recipients.
The case began when Bismarck attorney Tom Dickson negotiated a claim for a woman who was injured in a car accident. Dickson says the state was demanding too much money back from people who were compensated by insurance companies or other people.
State officials say about 150 people are eligible for the class.
The North Dakota settlement stems from a 2006 U.S. Supreme Court ruling in Arkansas, when justices said the state went too far in trying to take nearly half of a $550,000 settlement for a woman injured in a car accident.
