BISMARCK (AP) — Supporters of the University of North Dakota's Fighting Sioux nickname are taking their case to the North Dakota Supreme Court.
An attorney for a group of Spirit Lake Sioux tribal members filed an appeal notice with the Supreme Court late Friday.
North Dakota's Board of Higher Education is considering whether to drop the Fighting Sioux nickname and a logo that shows the profile of a Sioux warrior.
The tribal members say the board should have to wait until Nov. 30 before it takes final action. Board members say they could make a decision before then.
A district judge dismissed the case last month. Attorney General Wayne Stenehjem says the board has authority over the issue, and he doubts the appeal will be successful.
