BISMARCK, N.D. (AP) — A lawyer for former North Dakota workers compensation director Sandy Blunt says prosecutors withheld crucial evidence in Blunt's felony trial.
Blunt was convicted in December 2008 of misspending more than $26,000 in Workforce Safety and Insurance funds. North Dakota's Supreme Court upheld his conviction.
Blunt's lawyer, Mike Hoffman, filed papers in state district court on Thursday asking a judge to dismiss the case or grant Blunt a new trial.
Hoffman says prosecutors didn't provide copies of police interviews of some key witnesses, even though Hoffman asked for them.
Burleigh County prosecutor Cynthia Feland has already asked a judge to determine whether she broke any rules in failing to turn over material to Blunt's lawyer.
