MINOT, N.D. (AP) — A Canadian man who was deported after a conviction in the United States says he will plead guilty for entering North Dakota illegally.

Theodore Halter is charged in federal court with re-entry of a deported alien. Authorities say he climbed over a fence near the International Peace Gardens on Aug. 27.

The 55-year-old Halter was deported on March 10 after he was convicted in Minnesota of felony domestic assault. He told investigators he was on his way to Rochester, Minn., to settle a personal issue with the Social Security Administration.

Halter faces a maximum penalty of 10 years in prison.
