FARGO, N.D. (AP) — The attorney for a male North Dakota State University student accused of secretly recording nude videos of a female roommate says he's not sure a new charge filed against his client fits the alleged crime.

William Kirschner tells The Forum newspaper that he might mount another legal challenge on behalf of Anoop Singh.

The case against the senior was dismissed earlier this fall when a judge said a new state law barring the secret creation of sexually expressive images was unconstitutional. Prosecutors have now filed a disorderly conduct charge.

Singh is to be arraigned on Dec. 9. He also is scheduled to graduate in December.
