Jeffery Owen-Clyde Nichols, 33, 402 Second Ave. N.W. #105, was sentenced on charges of aggravated assault and violation of a domestic violence protection order, Class C felonies. He was accused of on or about Sept. 16 of willfully causing serious bodily injury to another human being causing multiple fractures to the woman’s right orbit. He was accused of violating a protection order around Oct. 24 that was served to him on Sept. 22. The criminal complaint said it was at least the second violation; the other was on Oct. 7.
Judge John T. Paulson sentenced Nichols to three years on each charge to be served concurrently at the North Dakota Department of Corrections with 54 days credit for time served. He was ordered to pay a $400 criminal administration fee, a $100 defense/facility administration fee, $25 indigent defense application fee and $50 in victim-witness fees. He is not to have contact and was placed on supervised probation until Nov. 9, 2012.
A Class C felony carries a maximum sentence of five years in prison and a $5,000 fine.
Douglas Robert Roquette, 47, 708 Holiday Park Village, was sentenced on charge of possession of a controlled substance with intent to deliver, a Class B felony, and a charge of prohibited acts A/controlled substance, a Class C felony. He was accused of on July 14 of willfully possessing a controlled a controlled substance with intent to deliver, namely marijuana as well as possessing a controlled substance, namely hashish.
Judge Thomas E. Merrick sentenced Roquette to 180 days in the Stutsman County Correctional Center on each charge to be served concurrently. He was ordered to pay a $400 criminal administration fee, $100 defense/facility administration fee, $300 indigent recoupment, $25 indigent defense application fee and $50 in victim-witness fees. He is to obtain an evaluation and complete and recommended treatment. He is not to possess or own firearms. He was placed on supervised probation until Nov. 4, 2012.
A Class B felony carries a maximum sentence of 10 years in prison and a $10,000 fine.
Stephanie Lynn Ahner, 37, 1406 11th St. S.E., was sentenced on a charge of acquiring a controlled substance by misrepresentation, a Class C felony. She was accused of on or about in May of acquiring controlled substances by submitting forged prescriptions.
Judge John Greenwood ordered Ahner to pay a $400 criminal administration fee, a $100 defense/facility administration fee and a $25 victim-witness fee. She is to complete a chemical dependency evaluation and complete recommended treatment. She is not to possess or own firearms. She was placed on supervised probation until May 18, 2012. She received a deferred imposition of sentence.
Carol Ann Crow, 57, 1504 Gardenette Drive Apt. 1, was sentenced on a charge of possession of a controlled substance, a Class C felony. She was accused of willfully possessing a controlled substance, namely methamphetamine in June.
Judge Thomas E. Merrick sentenced Crow to 30 days in the Stutsman County Correctional Center. She was ordered to pay a $400 criminal administration fee, $100 defense/facility administration fee and $25 victim-witness fee. She is not to possess or own firearms and was placed on supervised probation until Nov. 15, 2013.
