Canadian sentenced on charge of re-entry of a deported alien

U.S. Attorney Timothy Q. Purdon announced that on Jan. 3, Theodore Allan Halter, 55, of Canada was sentenced before U.S. District Court Judge Daniel L. Hovland on a charge of re-entry of a deported alien.

U.S. Attorney Timothy Q. Purdon announced that on Jan. 3, Theodore Allan Halter, 55, of Canada was sentenced before U.S. District Court Judge Daniel L. Hovland on a charge of re-entry of a deported alien. Halter pleaded guilty to the charge on Sept. 29.

Hovland sentenced Halter to three years and 10 months in federal

prison to be followed by two years of supervised release. Halter was ordered to pay a $100 special assessment to the Crime Victim’s Fund.

On Aug. 27, Halter was walking along the shoulder of U.S.

Highway 281, three miles south of the Dunseith port of entry, when he was

approached by a border patrol agent, authorities said. Halter admitted to the agent that he was a Canadian citizen and had entered the U.S. without authorization by climbing over a fence near the International Peace Garden. Halter was previously deported from the United States to Canada on March 10, 2010, after having been convicted in Minnesota state court for domestic assault by strangulation.

The case was investigated by the U.S. Border Patrol.

Assistant U.S. Attorney David Hagler prosecuted the case.
