Four sentenced in district court

Four people were convicted on felony charges in Southeast District Court in Jamestown.

Curtis James Anderson, 22, 410 Sixth Ave. N.W., pleaded guilty to burglary, a Class B felony.

Anderson was accused of entered an apartment at night, knowing he was entering the dwelling of another without license, invitation or privilege to enter on April 4.

Judge Thomas Merrick sentenced Anderson to two years with one year and 180 days suspended and one day credit for time served. He is allowed work release. Anderson will be placed on supervised probation until Jan. 18, 2013. Anderson is to pay a $650 criminal administration fee, $100 defense/facility administration fee, $25 indigent defense application fee, $300 indigent recoupment, $25 victim-witness fee and $271 restitution.

He is not to possess or own firearms, nor is he to consume, possess or purchase any controlled substance.

A Class B felony is punishable by a maximum of 10 years in prison and a $10,000 fine.

Dylan Jay Biloff, 23, 615 Third Ave. N.W., pleaded guilty to possession of marijuana with intent to deliver, a Class B felony. He was also convicted of operating a vehicle under the influence of liquor or drugs, a Class A misdemeanor.

Judge Thomas Merrick sentenced Biloff to 30 months in the North Dakota Department of Corrections with 38 days credit for time served. Biloff was sentenced to four years, four months and 10 days supervised probation. He is to pay a $100 defense/facility application fee, $25 indigent defense application fee and $1,000 fine/state. He is not to possess or own firearms, nor is he to consume, possess or purchase any controlled substance. He is to obtain a chemical dependency evaluation and complete recommended treatment.

A Class A misdemeanor carries a maximum sentence of one year in prison and a $2,000 fine.

Zachary Lynn Fercho, 21, 219 Sixth Ave. N.E., pleaded guilty to possession of a controlled substance with intent to deliver, a Class B felony.

Fercho was accused of possessing marijuana with intent to deliver on Nov. 23.

Judge John Greenwood sentenced Fercho to 90 days with one day credit for time served. He was given two years deferred imposition.

Fercho is to pay $650 criminal administration fee, $100 defense/facility administration fee, $25 indigent defense application fee, $300 indigent recoupment and $25 victim-witness fee.

He will be placed on supervised probation for two years.

Kevin Lee Johnson, 34, Sykeston, N.D., pleaded guilty to possession of a controlled substance, a Class C felony. Johnson was accused of possessing methamphetamine on March 6.

Judge Thomas Merrick sentenced Johnson to 16 months in the North Dakota Department of Corrections with four days credit for time served. Johnson is to pay a $400 criminal administration fee, $100 defense/facility administration fee, $25 indigent defense application fee and $300 indigent recoupment.

A Class C felony is punishable by a maximum of five years in prison and a $5,000 fine.
