Mid-October trial set for ND shooting suspect

A mid-October trial has been scheduled for a North Dakota man who pleaded not guilty to three felonies in a shooting last October that left another man dead.

MANDAN, N.D. (AP) — A mid-October trial has been scheduled for a North Dakota man who pleaded not guilty to three felonies in a shooting last October that left another man dead.

The Bismarck Tribune reports that 25-year-old Steven Voegele (VOH'-guhl) of Mandan is to stand trial Oct. 10-14 on aggravated assault, reckless endangerment and terrorizing charges in the Oct. 2, 2010, shooting outside a party that police say was sparked by an argument over an iPod music player.

Voegele was injured and 22-year-old Xavier Thompson was killed. Court documents indicate the two men allegedly shot one another.

Prosecutors had wanted to try Voegele in early September together with a third man who faces misdemeanor charges, but Judge Cynthia Feland said that case has been assigned to another judge and will remain separate.
