HANKINSON, N.D. (AP) — The Richland County State’s Attorney’s office says it will not file charges against a Hankinson man who allegedly shot and killed another man after an argument this spring.
The Forum reported that 56-year-old Robert Arends had claimed self-defense after he shot 35-year-old Brian Eugene Smith of Hankinson in Arends’ driveway on April 3.
Authorities say that Arends had found a vehicle parked in his driveway at about 4 a.m., and Smith and the two other passengers inside had been drinking. Arends had asked Smith to leave his property but Smith assaulted Arends.
Assistant State’s Attorney Ron McBeth said Tuesday that that there would be no charges filed against Arends.
