BISMARCK, N.D. (AP) — A North Dakota man serving 30 years in prison for killing his brother in a dispute over land is appealing his murder conviction to the North Dakota Supreme Court.
Forty-six-year-old Rodney Chisholm of Manvel says the trial judge should have allowed more self-defense evidence.
A jury in May 2011 convicted Chisholm of beating his 59-year-old brother, Donald, to death with a steel pipe. Rodney Chisholm had argued that he defended himself against an angry, violent older brother who had a history of disputes with people over property.
