FARGO, N.D. (AP) — Fargo-based Gate City Bank is asking a federal judge to dismiss a class-action lawsuit that accuses the bank of improperly charging overdraft fees.
KFGO radio reports that Amber Pieloor of Underwood has filed a lawsuit in federal district court. She wants it to be expanded to include other Gate City customers who she says were treated the same way.
The lawsuit accuses the bank of changing the sequence of customers’ debit card issues, resulting in overdraft issues.
Gate City attorneys say the allegations are incorrect. They want a judge to throw out the lawsuit and award court costs to the bank.
