Two people sentenced on felony charges
Two people were sentenced on felony charges in Southeast District Court. Two people were sentenced on felony charges in Southeast District Court.
Linda Gail Semones, 40, 511 Fourth St. NW, pleaded guilty to possession of a controlled substance with intent to deliver, a Class A felony, and possession of drug paraphernalia and possession of marijuana while operating a motor vehicle, both Class A misdemeanors.
Semones was accused of possessing methamphetamine with intent to deliver on or about Dec. 16, 2011.
Judge John Greenwood sentenced her to five years in prison with the Department of Corrections and Rehabilitation with credit for three days served on the possession with intent to deliver charge. She was also sentenced to undergo a chemical dependency evaluation and complete recommended treatment, not possess or own firearms and serve supervised probation until May 17, 2018.
She was ordered to pay a $900 criminal administration fee, a $100 defense/facility fee and a $25 victim-witness fee.
Greenwood sentenced Semones to one year in prison on each misdemeanor charge to be served concurrently with the felony sentence.
A Class A felony is punishable by 20 years in prison and a $10,000 fine. A Class A misdemeanor is punishable by one year in prison and a $2,000 fine.
Scott Alan Vogel, 47, 1012 10th St. NE Apt. 4, pleaded guilty to two counts of possession of a controlled substance, both Class C felonies.
Vogel was accused of possessing diazepam, acetaminophen and hydrocodone without a prescription from a licensed practitioner on or about April 10.
Greenwood sentenced Vogel to two years suspended on each charge. He was also sentenced to two years supervised probation and to pay a $400 criminal administration fee, a $100 defense/facility administration fee, a $25 indigent defense application fee, a $300 indigent recoupment and $50 in victim-witness fees.
A Class C felony is punishable by five years in prison and a $5,000 fine.
