ND Supreme Court affirms molestation conviction
North Dakota's Supreme Court has affirmed the conviction of a man who was sentenced to 40 years in prison for sexually abusing a young girl.
BISMARCK, N.D. (AP) — North Dakota's Supreme Court has affirmed the conviction of a man who was sentenced to 40 years in prison for sexually abusing a young girl.
Vincente Chacano (vih-CEN’-tay shah-CAN’-oh) says the Adams County prosecutor dismissed the charges against him once. He was accused of repeatedly molesting a girl who was under age 15.
Chacano says the charges were refiled later without any further investigation.
The Supreme Court's ruling says the charges were refiled after an assistant attorney general decided to prosecute. The court says he wasn't required to do more investigating.
Chacano's case drew attention because he pulled a gun in the Adams County courtroom in Hettinger after a jury convicted him of the sexual assaults.
Chacano was convicted of two counts of attempted murder for the pistol incident.
