Michael James Baumgartner, 37, 813 12th St. NE, pleaded guilty to possession of a controlled substance and possession of a controlled substance with intent to deliver. Both charges are Class A felonies. He also pleaded guilty to possession of drug paraphernalia, a Class C felony.
Baumgartner was accused of possessing methamphetamine, possessing synthetic cannabinoids with intent to deliver and possessing drug paraphernalia used with drugs other than marijuana. The charges all were alleged to have occurred around Feb. 25.
Judge Thomas Merrick sentenced Baumgartner to one year at the Stutsman County Correctional Center with 305 days suspended on the possession of methamphetamine charge. He was also placed on supervised probation for two years.
In addition he was ordered to undergo a chemical dependency evaluation and pay a $900 criminal administration fee, $100 defense/facility fee, $25 indigent defense application fee, $300 indigent recoupment and $25 victim-witness fee.
On the charge of possession of synthetic cannabinoids with intent to deliver Baumgartner was sentenced to two years supervised probation and given a two-year deferred imposition of sentence. He was ordered to pay a $25 victim-witness fee.
On the charge of possession of drug paraphernalia Baumgartner was sentenced to one year at the Stutsman County Correctional Center with 305 days suspended. The jail term is to be served concurrently with the jail time sentenced for the possession of methamphetamine charge.
He was also ordered to pay a $25 victim-witness fee.
A Class A felony is punishable by 20 years in prison and a $10,000 fine. A Class C felony is punishable by five years in prison and a $5,000 fine.
Timothy Earl Gray, 52, 1210 Third Ave. SW, Apt. 12, pleaded guilty to theft of property, a Class C felony.
Gray was accused of taking property valued at more than $500 from a retail store between Dec. 5-19, 2011.
Judge Thomas Merrick sentenced Gray to 13 months in the North Dakota Department of Corrections. He was also sentenced to four years supervised probation and to pay $2,160 restitution, $400 criminal administration fee, $100 defense/facility administration fee, $25 indigent recoupment and $25 victim-witness fee.
Gary Luverne Hanson, 62, Valley City, pleaded guilty to three charges of possession of a controlled substance with intent to deliver, one charge of possession of drug paraphernalia, for use of a controlled substance other than marijuana and one charge of possession of drug paraphernalia. He was accused of possessing methamphetamine, a Class A felony, and possessing marijuana and hashish, Class B felonies, all on Dec. 18, 2011. The drug paraphernalia charges are Class C felony and Class A misdemeanors, respectively.
Judge John Greenwood sentenced Hanson to 20 months at the North Dakota Department of Corrections on each of the felonies along with 90 days on the misdemeanor charge. All the sentences are to be served concurrently. He received credit for time served since Dec. 18, 2011.
Hanson was sentenced to three years of supervised probation and ordered to pay a $900 criminal administration fee, $100 defense/facility administration fee, $25 indigent defense application fee, $300 indigent recoupment and $100 victim-witness fee on the felony charges.
He was also ordered not to possess or own a firearm for one year.
A Class B felony is punishable by 10 years in prison and fines of up to $10,000. A Class A misdemeanor is punishable by one year in prison and a $2,000 fine.
Ronald Duane Holzworth, 65, 705 14th St. NE, pleaded guilty to incest, a Class C felony.
Holzworth was accused of engaging in sexual acts with another person who was related to him on multiple occasions between Dec. 26, 2009, and Dec. 26, 2010.
Judge Thomas Merrick sentenced Holzworth to 18 months in the North Dakota Department of Corrections and Rehabilitation. Holzworth was also sentenced to five years of supervised probation and to pay a $5,000 fine/state, $400 criminal administration fee, $100 defense/facility fee and $25 victim-witness fee.
John Matthew Morehouse, 43, 401 Second Ave. NW, Apt. 109, pleaded guilty to interference with telephone during emergency calls, a Class C felony.
Morehouse was accused of intentionally removing, damaging or obstructing a telephone or telephone line to interfere with an emergency call Oct. 23, 2011.
Morehouse was sentenced to 120 days at the Stutsman County Correctional Center with seven days credit for time served. He is allowed work/school release.
He was also sentenced to pay a $25 victim-witness fee.
