Jurors deciding fate of 2 suspects in ND shooting

Jurors in Bismarck are determining the fate of two men accused in a Beulah shooting that left one man dead and another injured.

BISMARCK, N.D. (AP) — Jurors in Bismarck are determining the fate of two men accused in a Beulah shooting that left one man dead and another injured.

Richard Whitman and Cody Borner have pleaded not guilty to a murder conspiracy charge in the Jan. 31 death of Mike Padilla in his apartment and the wounding of his brother, Timothy Padilla of Billings, Mont.

Prosecutors say a dispute over money and drugs led to the shooting. Both suspects testified they brought guns to the apartment to deter violence, and that shots were fired in a struggle for the guns when the Padilla brothers came after them.

The trial began Monday and went to the jurors on Wednesday. After two hours they went home for the night with plans to resume deliberations in the morning
