Two people sentenced on felony charges

Two people were sentenced on felonies in Southeast District Court.

Daniel Delano Waltz, 32, 1206 Riverside Drive #7, pleaded guilty to possession of a controlled substance and possession of drug paraphernalia. Both charges are Class C felonies.

Waltz was accused of possessing methamphetamines and items used to ingest or inject drugs other than marijuana on April 13.

Judge Thomas E. Merrick sentenced Waltz to 10 days at the Stutsman County Correctional Center with credit for 10 days already served.

He was also ordered to undergo a chemical dependency evaluation and placed on supervised probation for two years. On the possession of methamphetamines charge, Waltz was ordered to pay a $400 criminal administration fee, $100 defense/facility fee, $25 indigent defense application fee, $300 indigent recoupment and $25 victim-witness fee. On the drug paraphernalia charge Waltz was ordered to pay a $25 victim-witness fee.

A Class C felony is punishable by five years in prison and a $5,000 fine.

Jessica Dawn Nelson, 28, 410 Sixth Ave. NW, pleaded guilty to delivery of a controlled substance. The crime is a Class B felony punishable by 10 years in prison and a $10,000 fine.

Nelson was accused of delivering marijuana to another person on Nov. 21, 2011.

Judge John T. Paulson sentenced Nelson to 30 days of home confinement beginning Nov. 1. He also deferred the imposition of sentence and placed her on supervised probation for two years.

She was also ordered to pay a $650 criminal administration fee, $100 defense/facility fee, $71 restitution and $25 victim-witness fee.
