Three people sentenced on felony charges

Three people were sentenced on felony charges in Southeast District Court.
Reese Leonard Wahl, 35, 801 Fourth Ave. NE, pleaded guilty to criminal trespass, a Class C felony. He was accused of entering an apartment in Jamestown without permission or authorization on March 11.
Judge Thomas Merrick sentenced him to undergo a chemical dependency evaluation within one month. He was also given a two-year deferred imposition of sentence along with two years supervised probation and 100 hours of community service.
Wahl was ordered to pay a $25 community service supervision fee, $400 criminal administration fee, $100 defense/facility administration fee, $175 restitution and $25 victim-witness fee.
A Class C felony is punishable by five years in prison and a $5,000 fine.
James Robert Earnest, 30, 824 Fourth Ave. NE, pleaded guilty to aggravated assault, a Class C felony.
Earnest was accused of striking an individual in the head with a tire iron on March 29.
Judge John Greenwood sentenced Earnest to two years in the Stutsman County Correctional Center with 366 days suspended and credit for two days already served. He was sentenced to three years supervised probation.
Earnest was ordered to pay a $400 criminal administration fee, $100 defense/facility administration fee, $25 victim-witness fee and restitution to be determined at a later date.
Jordan Ray Kemmer, 20, Enderlin, N.D., pleaded guilty to criminal mischief, a Class B felony.
He also pleaded guilty to driving while license suspended, possession/consumption of alcohol by someone under 21 and reckless driving, all Class B misdemeanors, and making a false report to a law enforcement officer, a Class A misdemeanor.
All charges were related to an Aug. 4 incident in which Kemmer was accused of driving a vehicle without taillights that crashed into private property while his license was suspended and with alcohol in the vehicle. When his vehicle crashed into private property it caused about $18,000 in damage to trees and buildings.
Judge Thomas Merrick sentenced Kemmer to 90 days in the Stutsman County Correctional Center on the felony charge and prohibited him from owning or possessing a firearm for one year.
He was ordered to pay a $650 criminal administration fee, $100 defense/facility administration fee and $25 victim-witness fee on the felony charge.
On the charge of driving while his license was suspended he was sentenced to four days in jail and to pay a $25 victim-witness fee.
On the charge of possession/consumption of alcohol by someone under 21, he was sentenced to 30 days in jail and to pay a $325 fine and $25 victim-witness fee.
On the reckless driving charge he was sentenced to 30 days in jail and to pay a $25 victim-witness fee.
On the charge of making a false report to a law enforcement officer he was sentenced to 30 days in jail and to pay a $25 victim-witness fee.
All Kemmer’s jail sentences are to be served concurrently.
A Class B felony is punishable by 10 years in prison and a $10,000 fine. A Class A misdemeanor is punishable by a year in prison and a $2,000 fine. A Class B misdemeanor is punishable by 30 days in jail and a $1,000 fine.
