ND man acquitted of attempted murder in shooting

A North Dakota man accused of trying to kill his roommate in Grand Forks has been found not guilty of attempted murder.

GRAND FORKS, N.D. (AP) — A North Dakota man accused of trying to kill his roommate in Grand Forks has been found not guilty of attempted murder.

The Grand Forks Herald reports that jurors acquitted 27-year-old Travis Samshal of the charge Friday evening. But jurors found him guilty of the lesser charge of reckless endangerment, which carries a maximum sentence of five years in prison.

Samshal was accused of firing a hunting rifle at 35-year-old Leo Franco on Dec. 14, 2011. Samshal testified that he was afraid for his safety and that Franco had made unwanted sexual advances, which Franco denied.

Samshal also said he was only trying to scare Franco and deliberately missed when he pulled the trigger.
