Sex offender arrested in N.D.

William Upshaw, a Level 3 predatory sex offender, was arrested Wednesday in Wahpeton, N.D., by special agents from the FBI Minneapolis Division - Fargo Resident Agency.

On Monday, Upshaw was indicted in the Federal District of Minnesota, on three counts of “Child Pornography for Distribution” and one count of “Possession of Child Pornography.” An arrest warrant was issued for him. Upshaw previously resided and was registered as a sex offender in Minnesota.

The indictment and arrest warrant were based upon a search warrant and voluntary statements made by Upshaw indicating involvement in the possession and distribution of child pornography. Following the issuance of the arrest warrant, FBI agents from the Fargo Resident Agency tracked Upshaw to Wahpeton and arrested him without incident.
