One man sentenced on felony charge

One man was sentenced on a felony charge in Southeast District Court. Thomas Edward Hoggarth, 32, Montpelier, N.D., pleaded guilty to burglary, a Class C felony.

One man was sentenced on a felony charge in Southeast District Court.

Thomas Edward Hoggarth, 32, Montpelier, N.D., pleaded guilty to burglary, a Class C felony.

Hoggarth was accused of entering and remaining in a structure without permission with the intent to steal property in an incident on or about July 24.

Judge Thomas E. Merrick sentenced Hogarth to 120 days at the Stutsman County Correctional Center with credit for 14 days already served. Hoggarth was given the option of serving the sentence in Ward County and would be eligible for work release while incarcerated.

Hoggarth was also sentence to two years supervised probation and prohibited from owning or possessing a firearm for two years.

In addition, Hoggarth was ordered to pay a $400 criminal administration fee, $100 defense/facility administration fee, $325 indigent recoupment, $400 restitution and $25 victim-witness fee.

A Class C felony is punishable by five years in prison and a $5,000 fine.
