Four sentenced for felonies

Four people were sentenced on felony charges in Southeast District Court.
Michael Shea Carpenter, year of birth 1977, James River Correctional Center, pleaded guilty to possession with intent to deliver a controlled substance in a correctional facility, a Class A felony.
He was accused of possessing marijuana with intent to deliver while an inmate at the James River Correctional Center on July 14, 2012.
Judge Thomas E. Merrick sentenced Michael Carpenter to nine years at the North Dakota Department of Corrections and Rehabilitation to be served concurrently with any sentence he is currently serving.
Heather Michelle Carpenter pleaded guilty to a charge of delivery of a controlled substance in a correctional facility, a Class A felony.
She was accused of delivering marijuana to an inmate at the James River Correctional Center on July 14, 2012.
Judge John Greenwood sentenced Heather Carpenter to five years in prison with the North Dakota Department of Corrections and Rehabilitation. He also sentenced her to serve supervised probation and not to own or possess firearms until January 2020.
Heather Carpenter was ordered to pay a $900 criminal administration fee, $100 defense/facility fee, $25 indigent defense application fee, $300 indigent recoupment and $25 victim-witness fee.
Monty Ray Sabinash, 61, 218 10th St. SW, pleaded guilty to possession of drug paraphernalia, a Class C felony.
Sabinash was accused of possession of items used to process or manufacture controlled substances other than marijuana on June 14, 2012.
Judge Thomas E. Merrick sentenced Sabinash to two years of supervised probation. He was also ordered to undergo a chemical dependency evaluation and complete any treatment and not possess or own firearms for two years.
Sabinash was ordered to pay a $200 criminal administration fee, $100 defense/facility fee, $25 indigent defense application fee, $200 indigent recoupment and $25 victim-witness fee.
Elizabeth Louies Russell, 29, 607 Second St. SW, Apt. 101, pleaded guilty to delivery of a controlled substance, a Class B felony, possession of drug paraphernalia, a Class C felony, possession of drug paraphernalia, a Class A Misdemeanor, and possession of marijuana, a Class A misdemeanor.
Russell was accused of delivering marijuana on Aug. 12, 2011. She was accused of possession of items used to manufacture or produce items other than marijuana, possession of items used with marijuana and possession of marijuana all on or about March 6, 2012.
Judge Thomas Merrick sentenced Russell to 90 days at the Stutsman County Correctional Center on the delivery of marijuana charge. She was also sentenced to undergo a chemical dependency evaluation and complete treatment and not possess or own firearms for two years.
Russell was ordered to pay a $650 criminal administration fee, $100 defense/facility fee, $25 indigent defense application fee, $725 restitution and $25 victim-witness fee.
Russell was sentenced to 90 days in the SCCC on the possession of drug paraphernalia charge and 90 days in the SCCC on each of the misdemeanor charge. All four SCCC sentences are to be served concurrently.
A Class A felony is punishable by 20 years in prison and a fine of $20,000. A Class B felony is punishable 10 years and $10,000 in fines. A Class C felony is punishable by five years and $5,000 in fines. A Class A misdemeanor is punishable by one year in jail and a $2,000 fine.
