Three sentenced on felony charges

Three people were sentenced on felony charges in Southeast District Court.

Three people were sentenced on felony charges in Southeast District Court.

Holly Lynn Maxwell, 27, North Dakota State Penitentiary, pleaded guilty to one charge of theft of property, a Class A misdemeanor, two charges of theft of property, a Class B misdemeanor, one charge of dealing in stolen property, a Class C felony, and three charges of theft of property, a Class C felony.

Maxwell was accused of thefts from five businesses totally $7,887. She was also accused of selling items stolen items valued at $585. The incidents all occurred between July 1 and Aug. 5, 2012.

Judge Thomas E. Merrick sentenced Maxwell to 12 months and one day with the North Dakota Department of Corrections and Rehabilitation with credit for one day served. She was also placed on supervised probation and ordered not to own or possess a firearm for three years.

Maxwell was ordered to pay a $400 criminal administration fee, $100 defense/facility administration fee, $25 indigent defense application fee, $300 indigent recoupment and $25 victim-witness fee. She was ordered to make restitution of $5,940.72 jointly with Eric Kagle.

Eric Matthew Kagle, 25, 408 Third St. SE, pleaded guilty on Dec. 7, 2012, to two counts of theft of property, a Class B misdemeanor, one count of theft of property, a Class A misdemeanor, two counts of dealing in stolen property, both Class C felonies, and three counts of theft of property, all Class C felonies.

Kagle was accused of stealing merchandise valued at about $7,887 from five businesses between July 1 and Aug. 5, 2012. He was accused of selling stolen merchandise valued at $835 to two businesses in Jamestown during that same time period.

Merrick sentenced Kagle to 18 months at the Stutsman County Correctional Center and to five years of supervised probation. He was ordered to pay a $125 appointed attorney fee, $400 court administration fee, $100 facility improvement fee and $125 victim-witness fee. Kagle was ordered to make restitution as determined within 90 days.

Jalina Marie Hill, 40, 408 Fifth Ave. NE, pleaded guilty to theft of property, a Class C felony.

Hill was accused of knowingly taking a credit card of another person and using it to make purchases without permission.

Merrick sentenced Hill to a two-year deferred imposition of sentence. Hill was also placed on supervised probation and ordered not to possess or own a firearm for two years. Merrick also ordered Hill to perform 25 hours of community service.

Hill was also ordered to pay a $125 attorney fee, $25 community service supervision fee, $400 criminal administration fee, $100 defense/facility administration fee, $807 restitution and $125 victim-witness fee.

A Class B misdemeanor is punishable by 30 days in jail and a $1,000 fine. A Class A misdemeanor is punishable by one year in prison and a $2,000 fine. A Class C felony is punishable by five years in prison and fines of $5,000.
