Judge: No basis for suit

A U.S magistrate judge says a former Navy sailor who now lives in Kenmare does not have grounds to sue the military for injuries he allegedly suffered in a 1975 accident.

BISMARCK (AP) — A U.S magistrate judge says a former Navy sailor who now lives in Kenmare does not have grounds to sue the military for injuries he allegedly suffered in a 1975 accident.

Dean Oberg said he never received medical treatment after a 50-gallon garbage container fell on him while he was aboard the USS John Paul Jones. He filed a civil complaint in federal court in October.

Oberg is seeking to have his medical bills, massage therapy and prescription drugs paid, and is asking for $3 million as compensation for “pain. suffering, mental an-guish, discrimination and lost income for 33 years unemployment.”

U.S Magistrate Judge Charles Miller is recommending that the complaint be dismissed “for failure to state a claim upon which relief can be granted.”
