U.S. Attorney Drew H. Wrigley announced on Monday that Robert W. Rutherford, formerly of Bismarck, N.D., was sentenced before U.S. District Court Chief Judge Daniel L. Hovland on two counts of threat by interstate communications.
Rutherford, 47, pleaded guilty on Nov. 24, 2008. The incidents occurred
between April 10, 2007, and June 27, 2007, when Rutherford mailed letters threatening death or injury of two Bismarck residents, Wrigley said.
Hovland sentenced Rutherford to serve six years and two months in federal
prison, to be followed by three years of supervised release. Rutherford was ordered to pay a $200 special assessment to the Crime Victim's Fund.
The case was investigated by the Federal Bureau of Investigation and the Burleigh County Sheriff’s Office.
Assistant United States Attorney Clare Hochhalter prosecuted the case.
