U.S. Attorney Drew H. Wrigley announced this afternoon that Kevin J. Nadeau, 26, of Belcourt, N.D., was sentenced on a charge of assault resulting in serious bodily injury and a charge of assault with a dangerous weapon.
A federal jury found Nadeau guilty of the charges on Sept. 25, 2008.
U.S. Chief Judge Daniel L. Hovland sentenced Nadeau to serve four years and three months in federal prison, to be followed by three years of supervised release, on each charge, to be served concurrently. Nadeau was ordered to pay restitution for medical expenses in the amount of $26,011 and to pay a $200 special assessment to the Crime Victim’s Fund.
On the evening of Nov. 8, 2007, Nadeau was at his home north of Belcourt. He became concerned when a car was seen near his home. Wrigley said Nadeau incorrectly assumed that the people in the car were there to harass his family. The car left the area and Nadeau pursued it with his vehicle. Nadeau flashed his lights and the car pulled over. The driver of the car approached Nadeau’s vehicle to see what he wanted.
Nadeau assaulted the driver of the other vehicle by hitting him with a metal pipe. The victim suffered a fracture to his cheekbone which required surgical repair.
The case was investigated by the Bureau of Indian Affairs-Turtle Mountain Agency and Federal Bureau of Investigation. Assistant United States Attorneys Brandi Sasse Russell and David Hagler prosecuted the case.
