Man cited for failing to yield in death

Bismarck’s assistant city attorney says a man whose pickup struck and killed a pedestrian downtown will be cited for failing to yield to a pedestrian in a crosswalk.

BISMARCK (AP) — Bismarck’s assistant city attorney says a man whose pickup struck and killed a pedestrian downtown will be cited for failing to yield to a pedestrian in a crosswalk.

Authorities said Victor Richter was making a left turn in Bismarck on Dec. 10 when his pickup struck and killed 70-year-old Delmer Grabatin, who was crossing the street.

Police said the 79-year-old Richter did not stop, and witnesses followed him to a parking lot. He told police he did not know he had struck anyone.

Assistant City Attorney Paul Fraase said his options for charges in city court were limited to reckless driving and failure to yield to a pedestrian in a crosswalk. He said a reckless driving charge did not seem to fit.

The failure to yield charge carries a $20 fine.
