Couple suing over kids’ haircuts for drug tests
A man and woman are suing Traill County Social Services and two social workers, saying their children were wrongfully put in protective custody after getting unauthorized haircuts during a drug probe.
BISMARCK (AP) — A man and woman are suing Traill County Social Services and two social workers, saying their children were wrongfully put in protective custody after getting unauthorized haircuts during a drug probe.
Ricky Gonzales and Cassandra Laymon said the county violated their civil rights by cutting the hair of their three children at their school to see if they were exposed to marijuana.
The lawsuit filed in federal court seeks a jury trial and unspecified damages.
Court records said the children were taken from home after a positive test. But more tests showed the earlier tests were false and the children were returned home about a week later.
Kim Jacobson, the director of the Traill County Social Services, would not comment on the case. Agency attorney Daniel Gaustad said the lawsuit “doesn’t have any merit.”
