Suko sentenced on charges

A Jamestown man was sentenced to three years in prison on two counts of gross sexual imposition Tuesday.

Seth Allen Suko, who is either 21 or 22, 324 Third Ave. SW, appeared before Judge John Greenwood in Southeast District Court in Jamestown and entered a guilty plea on both charges.

Suko was charged with having sex with a victim under the age of 15 during August and September of 2012 in Barnes County. The second charge alleged he also had sex with a victim under the age of 15 in Stutsman County during the same period. Both charges are Class A felonies and were combined for sentencing.

Fritz Fremgen, Stutsman County state’s attorney, recommended three years in prison followed by 10 years of supervised probation and lifetime registration as a sex offender.

“He has a child he sees very little and is behind on child support,” Fremgen said. “I don’t know where his mind is. If he thinks this is like playing Xbox and these are characters on a screen.”

William Mackenzie, court-appointed defense counsel, recommended Suko be sentenced to perform 600 hours of community service, serve five years of probation and register as a sex offender.

“The defendant was with the wrong person at the wrong time,” he said. “You can’t put everyone in prison for three years because they make stupid mistakes.”

Suko said he regretted the incident.

“I made a mistake,” he said. “I was scared this would happen and it ended up happening this way anyway.”

Greenwood consolidated both cases and sentenced Suko to three years with the Department of Corrections with credit for time served, five years of supervised probation and lifetime registration as a sex offender.

Suko remains free on a $500 bond. He is scheduled to report to serve his sentence at 9 a.m. Friday.

A Class A felony is punishable by 20 years in prison and a $10,000 fine. The minimum penalties for the charge are five years of probation and registering as a sex offender for 15 years.
