Man pleads not guilty to aggravated assault

Eureka “Lefty” Mims pleaded not guilty to a charge of aggravated assault in Southeast District Court Thursday.

Mims, 42, Jamestown, appeared with his attorney, Richard Edinger, for a preliminary hearing on the Class C felony charge. The hearing was held and Judge John Greenwood determined there was enough evidence to proceed to trial. No trial date was set. Mims remains free after posting a $20,000 cash bond on Feb. 5.

A Class C felony charge has a maximum penalty of five years in prison and a $10,000 fine.

According to court documents, Mims allegedly stabbed Marlin Decoteau Jr., 34, of Jamestown twice on Jan. 30 outside of the Wonder Bar Sports Bar. The two men had gotten into an altercation earlier in the evening.

Decoteau was taken by Jamestown Area Ambulance to the Jamestown Regional Medical Center after the assault. He was later airlifted to Sanford Medical Center in Fargo. No information was provided at the preliminary hearing about Decoteau’s current medical condition.
