ADVERTISEMENT FOR BIDS
Sealed Bids for the construction of the Sewer and Water Replacement District #2019 Project will be received, by City of Medina, at the office of City Hall, 104 2nd Avenue Southwest, Medina, ND 58467, until 11:00 a.m. local time on June 27, 2019, at which time the Bids received will be publicly opened and read. The Project consists of sewer relining and water main replacement throughout the city.
Bids will be received for a single prime Contract. Bids shall be on a unit price basis.
The Issuing Office for the Bidding Documents is: Moore Engineering, Inc.; 2911 North 14th Street, Suite 301, Bismarck, ND 58503; Melissa Rotzien; 701.751.8360; mrotzien@ mooreengineeringinc.com. Prospective Bidders may examine the Bidding Documents at the Issuing Office on Mondays through Fridays between the hours of 8:00 AM to 5:00 PM, and may obtain copies of the Bidding Documents from the Issuing Office as described below.
Bidding Documents also may be examined at the following location: City of Medina, 104 2nd Avenue Southwest, Medina, ND 58467 Mondays through Fridays between the hours of 12:00 PM to 5:00 PM.

Each bid must be accompanied by a separate envelope containing a bidder's bond in a sum equal to 5% of the full amount of the bid executed by the bidder as principal and by a surety, conditioned that if the principal's bid is accepted and a contract is awarded to the principal, the principal, within ten (10) days after the notice of the award, shall execute a contract in accordance with the terms of the bid and the bid bond, and any conditions of the City of Medina, as required by law. A countersignature of a bid bond is not required. If the City of Medina elects to award a contract to the lowest responsible bidder, and the lowest responsible bidder does not execute a contract within ten (10) days, the bidders bond will be forfeited to the City of Medina, and the City of Medina may award the project to the next lowest responsible bidder.
Bid Bonds must be executed by a principal. Signatures other than a president, vice president, or CEO, must be accompanied by sufficient evidence (duly executed meeting minutes, resolutions, power of attorney, etc.) to indicate that the signatory has the authority to bind the company or organization.
Each bidder must possess a valid North Dakota contractors license for the full amount of their bid, as required by N.D.C.C. 43-07-7. Each bidder MUST enclose a copy of their Contractors License or Certificate of Renewal, issued by the North Dakota Secretary of State, in their bid bond envelope, and each license must be valid and dated at least 10 days prior to the date set for bid opening, as required under N.D.C.C. 43-07-12.
The City of Medina will not read or consider any bid that does not fully comply with the requirements above, or the requirements of N.D.C.C. 48-01.2-05. The City of Medina will reseal any deficient bid submitted and return it to the bidder immediately.
Section 746 of Title VII of the Consolidated Appropriations Act of 2017 (Division A - Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2017) and subsequent statutes mandating domestic preference applies an American Iron and Steel requirement to this project. All listed iron and steel products used in this project must be produced in the United States. The term "iron and steel products" means the following products made primarily of iron or steel: lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and construction materials. The deminimis and minor components waiver apply to this contract.
Bidders on this work will be required to comply with the Presidents Executive Order No. 11246, as amended. The requirements for bidders and contractors under this order are explained in the specifications.
