Auditor present budget request of $41,828.38 or 38 Mills whichever is greater.
Krapp made motion to approve final budget request, 2nd by Schlecht, MC
Steckler moved to adjourn budget hearing, 2nd by Klein.

319 Grant-Have about $96,000.00 left in grant for BMP's. Dustin has contacted some Cattle owners in watershed if interested in conservation efforts. Water sampling-DO are reading same as last year, Temperature of water seems cooler this year.
SE Outlet-no word yet-may need to write letter to legislators again. Dustin read email from Jim Collins received stating that this Water Quality project was started 3 years ago. Kirk visited with BJ to see if anything behind the scenes causing this project not to move forward, he stated not that he knows. The final project with answers to the State Water Board questions was submitted Feb 2021 but had been originally submitted earlier.
Auditor attended Stutsman County Water Board meeting at which pumping to Schock Lake was again discussed. Easements and levels of Lake were discussed.

Speed bumps on Glenwood Avenue by campgrounds discussed-gravel ones are fine but not visible. Eric has painted and put-up lots of cones that were destroyed. Feels correct signage is needed and reflective markers.
Steckler moved to purchase 5 speed bumps that cover width of Glenwood Ave and 10 reflective markers to mark speed bumps, along with proper signage, 2nd by Schlecht.
Walking Path Update-Kirk will mow path this fall after getting agreement signed with Leasee, and work on signage needed over the winter.
Auditor recommended we transfer funds to NEW savings account for Highway funds in the amount of $43,952.76 from savings and 4,648.63 from checking for a total of $48,601.39.
Krapp move to transfer funds, 2nd by Klein.
Auditor received proposal for legal services being provided from Swanson & Warcup LTD, felt need to table till full council is present.
Auditor will be submitting application on October 7th after Mayor signs paperwork needed.
Road graveling-will access roads and get on list for Spring if needed.
New Business:
Jon and Peg Schlenker attended Stutsman County Water board to find out if the pump house is still needed and who is responsible for upkeep as building needs painting. It was determined to be needed for future use of lake elevation reading and that the City of Spiritwood Lake responsible for maintenance. They requested building be painted. Steckler moved to hire a painter for pump house using funds from Lake Restoration account 2nd by Schlecht.
Auditor presented the agreement received from firm of Swanson & Warcup, LTD located in Grand Forks, ND to act as City Attorney when needed per rates outlined in agreement.
Steckler moved to retain firm for legal counsel as needed 2nd by Krapp.
Discussion on dumpster rates and sizes of dumpsters around the lake was held at this time. Tabled until we get rate increase numbers from CDS.
Schlecht motion to set Waste Management rate of $350.00 for Air BNB 2nd by Steckler.
Snow removal-Chip Steckler agreed to continue with removal with snow blower. Krapp made motion to issue a startup fee of $500.00 2nd by Schlecht, Steckler abstained.
Krapp motion to adjourn at 9:15 PM, 2nd by Klein
Next council meeting will be Nov 2, 2021 7:30 pm Chip Steckler Shop 617 Spiritwood Avenue.
