Mayor Heinrich called the special meeting of the City Council to order at 5:05 PM.
The Pledge of Allegiance to the flag was recited.
Roll Call showed the following members present: Mayor Heinrich, Council Members Kamlitz, Schloegel and Steele, Assistant City Attorney Geroux, and City Administrator Hellekson. Council Member Buchanan was in listen-only mode.
Council Member Schloegel moved to approve the minutes of the Special Assessment Commission meeting, October 26, 2020. Seconded by Council Member Steele. Unanimous aye vote. Carried.
A public hearing was held concerning the special assessment list for the Seal Coat, Patching, Construction and Reconstruction District #19-41. No one appeared to object, and no written protests were received. The public hearing was closed.
Council Member Steele moved a Resolution to approve the special assessments for Seal Coat, Patching, Construction and Reconstruction District #19-41, in the total amount of $2,471,130.46, less the City Share of $427,974.38, with the balance of $2,043,156.08 to be assessed to benefited properties within the district. Seconded by Council Member Schloegel. Roll Call No. 1 showed: 4 ayes, 0 nays, 1 absent. Carried.
A public hearing was held concerning an ordinance to amend and re-enact Section 4 of Appendix C, and to enact Section 5.4.4 of Appendix C of the City Code of the City of Jamestown, ND, pertaining to Planned Unit Development District (PUD), as amended by the Planning Commission on October 9, 2020. No one appeared to object, and no written protests were received. The public hearing was closed.
Ordinance No. 1540, introduced by Council Member Kamlitz, to amend and re-enact Section 4 – Establishment of Districts, and to enact Section 5.4.4. Planned Unit Development District, all of Appendix C of the City Code, as amended, by the Planning Commission on October 9, 2020, had its second reading. Seconded by Council Member Steele. Roll Call No. 2 showed: 4 ayes, 0 nays, 1 absent. Carried.
Council Member Steele moved a Resolution to approve additional emergency measures to lessen the spread of COVID-19. Seconded by Council Member Schloegel. Council Member Schloegel expressed concern regarding the lack of penalty for noncompliance since many citizens feel something should be done to slow the virus and the city leadership is responsible in a crisis to act accordingly. Council Member Steele stated that a virus needs a host and that if people stayed home, avoided gatherings for the holidays, and wore masks, that would be the easiest way to stop the virus. Chief Edinger provided concerns regarding enforcing penalties related to a pandemic which falls under Public Health. Assistant City Attorney Geroux stated that this resolution is not the appropriate mechanism for penalties, but that can be accomplished through other mechanisms. Roll Call No. 3 showed: 4 ayes, 0 nays, 1 absent. Carried.
Council Member Schloegel moved to adjourn at 5:40 PM. Seconded by Council Member Steele. Unanimous aye vote. Carried.
