BISMARCK (AP) -- The trial for a North Dakota state House member accused of punching his wife has been pushed back to August.
Dave Weiler had been scheduled to stand trial next week for simple assault. But court records say the trial's been changed to Aug. 27.
Weiler pleaded guilty last year to a separate charge of assaulting his estranged wife, Nicole. Dave Weiler has insisted he is innocent of the most recent charge. His wife says Weiler punched her in the face.
He faces up to a year in jail and a $2,000 fine if convicted.
Weiler represents parts of south Bismarck and the city of Lincoln. A group of his constituents are circulating a petition to ask for a recall election this November to oust him from office. Weiler's four-year term doesn't end until December 2012.
