ABERDEEN, S.D. — A Sisseton business owner and his business have been indicted by a federal grand jury for embezzlement and theft from an Indian Tribal Organization, according to a news release from the U.S. attorney's office.

Dustin M. Kirk, 46, of Sisseton was indicted in March on two counts of embezzlement and theft from an Indian Tribal Organization. Two counts in the indictment relate to his dissolved business, Siouxland Lumber & Materials, LLC. Kirk has pleaded not guilty to the charges and trial is set for Sept. 24.

Charges in the indictment involve activity between August 2016 and December 2018. Kirk and his business are accused of embezzling, stealing and converting more than $1,000 belonging to Dakota Nation Development Corporation and the Sisseton-Wahpeton Housing Authority, both of which are entities of the Sisseton-Wahpeton Oyate Sioux Tribe and Indian Tribal Organizations.
