A Jamestown man remains in custody on $25,000 bond after formal charges of gross sexual imposition, a Class AA felony, aggravated assault and felonious restraint, Class C felonies, and two counts of ingesting a controlled substance, a Class A and Class B misdemeanors, were filed.

Samuel Mittleider, 24, was taken into custody Feb. 12 with formal charges filed in Southeast District Court on Feb. 16. Bond was set at $25,000 by Judge Daniel Narum on Feb. 18.

According to court documents, Mittleider is accused of leading a 15-year-old girl into a room in the Buffalo Motel on the evening of Feb. 11 and forcing the victim to perform a sexual act by force or threat of imminent death or serious bodily injury. He is also accused of impeding the airflow to the victim's lungs and brain, restraining the victim by display of what appeared to be a handgun and ingesting marijuana and methamphetamine.

A Class AA felony is punishable by life in prison without parole. It has a mandatory minimum of five years in prison.

Mittleider is tentatively scheduled for a preliminary hearing on March 10. A felony jury trial is currently scheduled for June 15 before Judge Cherie Clark.
