FARGO, N.D. (AP) -- The attorney for the former owner of a Fargo simulcast horse racing company whose conviction for illegal gambling was overturned says prosecutors built their case on fabricated evidence.
Former Racing Services owner Susan Bala is suing Attorney General Wayne Stenehjem, former U.S. Attorney Drew Wrigley and three others, alleging they violated her constitutional rights.
Bala was convicted in 2005 on federal charges of illegal gambling. An appeals court overturned the verdict.
Defense attorneys told a judge Friday that Bala's lawsuit should be dismissed and that their clients are protected from lawsuits. Her attorney said she was the victim of a conspiracy and deserves her day in court.
