BISMARCK, N.D. (AP) -- A lawyer for a man charged with killing a Bismarck police officer says his client's health information should not be released to be used against him.
Fifty-two-year-old Steven Bannister has been charged with murder in the July shooting death of Bismarck Police Sgt. Steve Kenner. Another officer shot Bannister in the head during the incident. He was taken to St. Alexius Medical Center, where he later recovered.
The Bismarck Tribune reports ( http://bit.ly/px0g68 ) that Bannister's lawyer, Steven Mottinger, asked a judge to deny a motion by prosecutors to compel the hospital staff to submit to an informal interview with law enforcement.
Law enforcement had subpoenaed Bannister's medical records but wanted additional information from the hospital staff.
The next court hearing in the case is scheduled for Oct. 20.
