FARGO, N.D. (AP) -- A settlement in a federal class action lawsuit filed against the city of Fargo over traffic fines is going to a judge.
A motion filed Friday by attorneys in the case calls for $350,000 to be paid for attorney fees, including $83,200 to Tim Purdon, $70,100 to Robert Stock, $60,725 to Monte Rogneby and $38,275 to Mark Friese. The city agreed not to oppose any request for frees and costs unless it exceeded $350,000.
The two people who sued over the illegal traffic fines -- Stephanie Sauby of West Fargo and James Burns of Fargo -- would receive $10,000 and $5,000, respectively.
Attorneys say nearly 54,000 notices were sent to potential class members, and about 25 percent of those eligible have joined the lawsuit. Each class member would receive 65 percent of the difference between the fees that were paid and the amount set by state law.
A hearing for final approval is set for Nov. 30 before U.S. District Judge Ralph Erickson.
