Lawyers question N.D. day care lawsuit

BISMARCK (AP) -- The federal government says a lawsuit filed by a Sioux County woman for injuries her son allegedly suffered at a Standing Rock day care should be thrown out of federal court.

BISMARCK (AP) -- The federal government says a lawsuit filed by a Sioux County woman for injuries her son allegedly suffered at a Standing Rock day care should be thrown out of federal court.

Lisa McLaughlin is accusing the Sitting Bull College day care of negligence. She says her infant son, Cinch McLaughlin, suffered a brain injury in early 2008.

The United States says the court does not have jurisdiction because the day care workers are not federal employees and the day care does not receive funding under a federal assistance program.

A judge has not ruled on the motion to dismiss.
