Man serving life sentence sues over fall

FARGO (AP) -- A man sentenced to life in prison for killing a Valley City State University student is seeking $24 million for injuries he says he suffered in a fall at the Cass County Jail.

FARGO (AP) -- A man sentenced to life in prison for killing a Valley City State University student is seeking $24 million for injuries he says he suffered in a fall at the Cass County Jail.

Moe Gibbs filed a federal lawsuit Monday accusing a correctional officer of negligence and blaming the sheriff, jail and state for failing to provide proper medical attention.

His lawsuit said he suffered a wrist injury when he slipped and fell at the jail after a May 2007 meeting with his attorney.

Gibbs was convicted in November 2007 of strangling 22-year-old Valley City State student Mindy Morgenstern. He later pleaded guilty to a 2004 rape in Fargo, and to charges that he assaulted five female inmates at the Barnes County jail where he had worked as a jailer.
