FARGO-Search warrants filed in the case of a Cedar Rapids, Iowa, man accused of beginning a shootout with Fargo police as he fled an armed robbery at a downtown motel say he shot twice at one officer and once at another, with that shot penetrating the squad car and into a bag sitting next to the officer.

Eric Lee Webb shot twice at downtown resource Officer Todd Wahl as he was fleeing on June 4 from the Howard Johnson motel, where he had shot a round into a wall near a front desk clerk after demanding money, according to search warrants filed this week in Cass County District Court by special agents for the North Dakota Bureau of Criminal Investigation.

The shots Webb fired at Wahl missed, according to the search warrant, but the next one he fired at Officer Matt Niemeyer went into Niemeyer's squad car, connecting with a duty bag sitting on the front passenger seat.

Niemeyer then fired two rounds at Webb, the search warrant says, hitting him once in the back.

Special agents searched a brown four-door Honda Accord that was reported stolen from Marion, Iowa, near Cedar Rapids. They also searched Webb's medical records and cellphone records for evidence of messages he may have exchanged with his fiancee, Samantha Flick, before the robbery.

The search warrants state that a pair of blue rubber gloves were found in the car, and that witnesses reported seeing Webb wearing blue gloves at the motel.

Webb is charged in Cass County District Court with felony robbery and possession of a firearm by a felon.

BCI officials could not be reached for comment on the status of their use of force investigation.
