GRAND FORKS — A Fargo man pleaded guilty Monday, Feb. 4, to charges alleging he raped a woman he knew. The felony charge was reduced to a misdemeanor.

Arsenio Lamare Oquinn, 29, will spend 18 months on unsupervised probation. His initial charge was a Class A felony for gross sexual imposition, which holds a maximum sentence of 20 years in prison. During a change of plea hearing Friday, Feb. 1, the charge was amended to a Class A misdemeanor for sexual assault, which holds a maximum of 360 days behind bars.

An affidavit for his arrest said Oquinn had plans with a 19-year-old woman to have dinner and watch a movie. He arrived at the woman’s home in Grand Forks about 10 p.m. Oct. 25, 2017, with a six-pack of hard lemonade, the affidavit said.

The woman told investigators she drank two bottles of the lemonade but recalled the drink tasting more strongly of alcohol than normal, according to the affidavit.

After the second drink, the woman allegedly wasn’t feeling well and went to her bedroom to lie down. A court document said Oquinn helped her into the bed.

The woman told investigators she awoke face down on her bed and Oquinn was raping her.

Oquinn told police he had sex with the woman but said it was consensual, the affidavit said. He also denied bringing alcohol, but police found video footage from a nearby liquor store that shows him buying hard lemonade about 20 minutes before reaching the woman’s home.
